Did You Know?
- Various newspaper articles from the 1820s refer to a legal dispute between James Inglis and Henry Smith and seek the heirs of Elianor Elkins and Elizabeth Elkins. I suspect the dispute related to Eleanor's 1818 will (in which she made Henry her executor), but a page-check from the The National Archives revealed that the case runs to several hundred large pages and I'm not interested enough to pay such a large sum to obtain copies!
- Elizabeth Elkins was baptised in 1749 (by the new calendar), but she says in her will that she was 'married at the age of seventeen', so would have been born in about 1747.

WHEREAS by a Decree of the High Court of Chancery,
bearing date the 17th day of December 1825, made in
a cause wherein James Inglis and another are plainti?s, and
Henry Smith and others are defendants, it was referred to
James William Farrer, Esq, one of the Masters of the said
Court, to inquire and state to the Court who was or were the
heir or heirs at law of Eleanor Andrews, in the pleadings
named, at the time of her death, and who are or is now such
heirs or heir at law. - The heir or heirs at law of the said
Eleanor Andrews, formerly Elkins, late Housekeeper to Samuel
Yew, late of Leigh, in the Parish of Westbury, in the County
of Wilts, Esq. deceased (who was the daughter of William
Ilkince and Mary his wife, formerly Mary Ball, Spinster, was
married to Richard Andrews, Widower, late of Amesbury, in
the County of Wilts, on the 23d of November 1758, and
was buried on the 5th of April 1769, at Westbury, in the
County of Wilts), at the time of her death, and who are or
is now such heirs or heir at law, are, on or before the 2d day
of May next, to come in before the said Master, at his Cham-
bers, in Southampton-Buildings, Chancery-Lane, London,
and prove their heirship and make out their claims, or in de-
fault thereof they will be peremptorily excluded the benefit of
the said Decree.

This is the last Will and Testament of
me Elizabeth Elkins otherwise Elizabeth Edwards of the Parish
of Walcot in the County of Somerset Christened at the Parish Church
of North Bradley in the County of Wilts as Elizabeth the daughter
of Eleanor Elkins and married at the age of seventeen at Mary
le bone Chapel in the County of Middlesex by the name of Elizabeth
Yew Spinster to John Edwards formerly of London but afterwards of
Chalcot House in the said County of Wilts Esquire deceased but
which marriage never having been consummated and being in
Law void I have adopted and gone by the name of Elizabeth
Elkins Whereas under and by virtue of the last Will and Testam't
of Samuel Yew late of Westbury Leigh in the Parish of Westbury
in the said County of Wilts Esquire deceased I became entitled to a
considerable Real and Personal Estate And whereas Articles of
Separation were duly ???ted between me and the said John
Edwards by which the said John Edwards released all title and
claim to the Real and Personal Estate to which I became so
entitled as aforesaid so that the same with the Savings Increase (?)
and Accumulations thereof for many Years remains subject to my
disposition And whereas I am desirous to dispose of such the Real
and Personal Estate devised to me or for my benefit by the said
Samuel Yew and of a Sum of Stock in the Bank three PerCent
Consolidated Annuities belonging to me which was many Years
now invested in the Name of William Andrews late of the City of
London C???mist deceased and of the Rents of the said Real Estate
and of all the Savings Increase and Accumulations of the same
respectively and of all my real and personal Estate whatsoever in
manner hereinafter mentioned yet nevertheless my intention is not
to include in this my Will the little Property I have in Bath
which being of no great value I mean to give or deliver over in my
lifetime to the persons who have been attentive to me in my
illness and to whom it will be a considerable benefit Now I the said
Elizabeth Elkins otherwise Elizabeth Edwards do by this my last Will
and Testament signed published and declared by me in the presence of
the three credible persons whose names are hereunder written as
Witnesses then to give and devise limit and appoint all such Real
Estate whatsoever given or devised to me or for my benefit by the Will
of the said Samuel Yew and which under the said Will or the said
Articles of Separation or any power therein contained (?) respectively I
have any right or title to give or dispose of and of all other my
Real Estate whatsoever unto Henry Smith of Drapers Hall in the
City of London Esquire To hold to him his heirs and assigns for ever
upon Trust that he or his heirs do and shall as soon after my death
as conveniently may be absolutely sell and dispose of the same Real
Estate either together or in Parcels by Public Sale or Private Contract
and for the best Price or Prices they can reasonably obtain...

of Jemima Brotinam late of Bath Spinster deceased the Sum of
thirty Pounds borrowed of her on my note of hand with all interest
that shall be due thereon And also to pay to Maria Davis Harriet
Jane Davis and Elizabeth Mary Davis the three daughters of my
late esteemed friend Elizabeth Davis deceased the Sum of one thousand
Pounds and do and shall stand (?) possessed of and interested in the
residue of the money to arise and be obtained as aforesaid upon the
Trusts and to and for the intents and purposes following that is to say
As to three thousand Pounds part thereof for the Society called the
British and Foreign Bible Society As to three thousand Pounds other
part thereof for the Society called the Sub??? Society for establishing
Schools and ???lating the Holy Scriptures in ??? As to
two hundred Pounds other part thereof for the Society called the
Sick Mans Friend Society belonging to Argyle Chapel As to two
hundred Pounds other part thereof for the Society called the Sick
Mans Friend Society belonging to Lady Huntingdons Chapel As
to four hundred Pounds other part thereof for the Society called the
Strangers Friend Society belonging to the Chapel of the Wesleyan

I Samuel Yew of Leigh in the
Parish of Westbury in the County of Wilts Esquire do hereby
revoke all former and other Wills by me at any time heretofore
made and do declare and make this my last Will and
Testament to be as follows that is to say first of all I give to
Joseph Gilbert of Maddington in the County of Wilts Gentleman
the sum of ten Pounds of good and lawful money of Great
Britain to buy him Mourning and I give to such of his
Children as are hereinafter mentioned namely his sons
William and Joseph and to his Daughters Sarah and
Ann ten Pounds a Peice of like lawful money to be Paid to
them respectively within twelve Months next after my Decease
also I give to my Kinsman Thomas Gilbert of Bathweek
in the County of Somerset Gentleman the Sum of ten Pounds
of like money to buy him Mourning and to each of his
children namely Ann Mary and Thomas the Sum of Fifty

concerning the same real and Personal Estate that is to say
In Trust and to the use of Elizabeth Elkins otherwise Yew
Daughter of the said Elianor Elkins above named until her
Death or until her Marriage which first happens and
I desire the said Elianor Elkins and Thomas Gilbert or the
Survivor of them not to consent to the said Elizabeth Elkins
otherwise Yews Marriage before a settlement be made of
Messuages Lands and Hereditaments scituate in England
of an Estate in Fee Simple in Possession of the Value of Ten
thousand pounds or more of lawful money of Great
Britain to and upon the Uses Trusts Intents and purposes
hereinafter mentioned that is to say To the use of the Husband
of the said Elizabeth Elkins otherwise Yew during his natural
Life without Impeachment of Waste and from and after the
death of her Husband To the use of the said Elizabeth Elkins
otherwise Yew during her natural Life for her Joniture [sic] and
in lieu and in full satisfaction and recompence of all such
Dower or Title of Dower as she shall or may have or
claim in out of or to any Messuages Lands or Hereditz
whereof her said Husband shall be Seized in Deed or in Law
of any Dowable (?) Estate and from and after the Determination
of the said Estates so to be limitted on the said Elizabeth Elkins
otherwise Yew and her Husband respectively to the use of them
the said Elianor Elkins and Thomas Gilbert and their Heirs
during the natural Life of the Survivor of them the said Elizabeth
Elkins otherwise Yew and her Husband and for so long time
after as shall be necessary to Support and Preserve the
Contingent Uses and Estates hereinafter mentioned by Trust
to Preserve the same Contingent Uses and Estates by Entry or
otherwise and to Permit the Husband during his natural Life
to receive have and enjoy the Rents Issues and Profits of the
said Messuages Lands and Hereditaments and from and
after his decease to Permit the said Elizabeth Elkins otherwise
Yew to receive have and Enjoy the Rents and Profits of the
same Messuages Lands and Hereditaments and from and
after the death of the Survivor of the said Elizabeth Elkins
otherwise Yew and her Husband and the determination
of the Estate so to be l???itted to Preserve the same contingent
Uses and Estates to the use of the first Son of the Body of such
Husband on the Body of the said Elizabeth Elkins otherwise
Yew to be begotten and of the Heirs of the Body of the same
first Son and for default of such Issue to the use of the second
son ...

Elizabeth Elkins otherwise Yew shall happen to dye a Minor
and unmarried In Trust as for and concerning my Personal
Estate so given upon Trust as aforesaid the same Personal
Estate shall go to the Executors and Administrators of the
said Elizabeth Elkins otherwise Yew and as for and concerning
my real Estate given in Trust as aforesaid the same shall
go to and in Trust for Thomas Gilbert Son of the said Thomas
Gilbert of Bathweek aforesaid Gentleman his Heirs and
Assigns forever and to for and upon no other use trust intent
or Purpose whatsoever and I do hereby appoint the said
Elianor Elkins and the said Thomas Gilbert the Father
Guardians of and over the said Elizabeth Elkins otherwise
Yew during her Minority or until her Marriage and lastly
I give to the said Elizabeth Elkins otherwise Yew all my real
Estate not hereinbefore given To hold to the said Elizabeth
Elkins otherwise Yew ...er Heirs and Assigns forever and all
my Personal Estate not hereinbefore given I give unto the said
Elizabeth Elkins otherwise Yew her Executors Administrators
and Assigns for ever and I hereby Constitute and appoint the
said Elianor Elkins and Thomas Gilbert the Father Executors
in Trust of this my last Will and Testament until the said
Elizabeth Elkins otherwise Yew shall attain the age of Twenty
one Years and then I constitute her Executrix thereof in
Witness whereof I have to this my last Will and Testament
Set my hand and Seal the Eighteenth Day of August in

in two Sheets or Peices of Paper was by the Testator Samuel
Yew Signed Sealed Published and declared in our Presence
to be his last Will and Testament and immediately afterwards
this Writing was Subscribed and attested by us as witnesses
thereto and to his Signing and Sealing both Sheets in the
Presence of the said Testator and of each other the Words of
