In the name of God amen The nine and twentith [sic] daie of December in the yeare of our lord god one thousand six hundred and eight and twenty I Richard Howsden of Hinxton in the countie of Cambridge being in perfect minde and memorie thankes be giuen to god, make and ordaine this my last will and testament in manner and forme followinge vizt In primis I bequeath my sowle into the handes of allmightie god my blessed maker and redeemer by whose most precious blood I expect remission of all my sinnes and inheritance incorruptible amongst his most blessed saintes Item I will that my bodie be decentlie buried in the ~~parishe~~ [struck through] church yard of the parish of Hinxton aforesaid Item I giue vnto the poore of Hinxton six poundes to be distributed amongst them at ye discrecion of my Executrix vizt three poundes at or on the daie of my buriall, and the other three poundes within one yeare next after my decease Item I giue vnto Richard Howsden the sonne of my brother George Howsdene all those my landes and tenements whatsoeuer I haue lyinge and beinge within the boundes and feildes [sic] of much Halingbury in the countie of Essex to hold vnto him the said Richard his heires & assignes foreuer Item I giue vnto Anne Howsden my sister all those my Freehold landes and tenements whatsoeu[er] lyinge and being in Hinxto[n] to haue and to hold vnto her duringe her naturall life And after her decease, then all the said landes and tenements to remaine vnto the abouesaid Richard Howsden the sonne of my brother George and to the heires of the said Richard foreuer uppon condicion notwithstandige followinge That the said Anne and Richard, and the heires of the said Richard doe well and truly content and paie or cawse to be well and trulie contented and paid vnto Margarett Howsden one of the daughters of John Howsden of Hinxton, or to such person or persons as shall keepe and mantaine the said Margarett, for and towardes her maintenance of liuinge at or in the porch of the parishe church of Hinxton the some of Fiue poundes of lawfull englishe money in and vppon the Feast daie of St Michaell Tharchangell yearlie duringe her life But if the said su[m]me of Five poundes yearelie be vnpaid accordinglie Then my minde and will is that the said Margarett and such her freindes as shall keepe her shall haue and enioy the said landes and tenements to her vse duringe her naturall life And after her decease, then to remaine to the vse and behoofe of the said Anne and Richard, and the heries of the said Richard, foreuer Item I giue vnto the said Richard Howsden my brothers sonne all those my Customary or coppyhold [sic] landes & tenements, whatsoeuer I hold in Hinxton to be vnto him and his heires foreuer Provided nevertheles my will is, that the said Anne Howsden my sister shall haue hold and inioy all the profitts that shall yerely arrise and growe vppon the said coppyhold landes and tenements without the deniall or molestation of the said Richard his heires or assignes duringe her naturall life Item I giue vnto my brother George Howsden twentie poundes of lawfull englishe money to be paid within one whole yeare after my decease Item I giue vnto Richard Howsden the sonne of my brother George Howsden twenty poundes of the like lawfull money to be paid vnto him within one whole yeare after my decease Item I giue vnto the fower daughters of my brother George Howsden Fower score poundes of lawfull englishe money) [sic] to be deuided equallie betweene them and to be paid vnto them within one whole yeare after my decease, Item I giue vnto William Howsden the sonne of my brother George Howsden six hundred poundes of lawfull englishe money to be paid vnto him in manner and forme followinge vizt two hundred poundes within one yeare after my decease, other two hundred pounds within two whole yeares after my decease, and the other two hundred poundes within thre [sic] whole yeares after my decease in full payment of the six hundered poundes Item I giue vnto Robert Swan & Edward Swan the two sonnes of my sister Justice Swan twentie poundes of lawfull englishe money equally to be deuided Betweene them, to be paid vnto them deceased three score poundes of lawfull english money to be paid vnto him within one whole yeare after my decease Item I giue vnto Katheren Ellis, Mary Ellis and Avis Ellis ye daughters of my sister xijo die Nouemb ...644 To the righte honnorable the Erles of Kent and Bullingbrooke and others Commissioners for the Great Seale of England Hales Humbly complayning shewethe vnto your hon:es your Orators Christopher Emm... of London Merchant and Alice Housden widdowe Executrixe of the last will and Testament of John Housden deceased That ... in Easter Terme 1634 the sayd Richard Housden and Thomas Ellis exhibited another Bill of complaynt into this honnorable Court against the sayd John Housden ... as Administrators of the goods and chattels of the sayd Anne Housden ... ...And the sayd Arbitrators do also Award Order and Judge That the sayd Richard Housden and Thomas Ellis theire executors administrators or assignes shall well and truly pay or cause to be payd by the sayd John Housden his executors or assignes the summe of one hundred and forty p... e...ing at or in the porche of the sayd Parrishe Churche of Hinxton in full discharge of the summe of three hundred pounds intended and directed to be given and payd by the privat Nuncupative Will of Richard Housden deceased And vppon payment & receipt of the sayd hundred & Forty pounds the sayd John Housden or his Asignes ... and Thomas Ellis or one of them out of the sayd hundred and for...nds the summe of Twenty pounds in full discharge and satisfacc[i]on of an obligac[i]on dated the sixt [sic] day of December in the thirteenthe yeare of King James wherin the sayd John Housden and Edward Housden his Father deceased were bound to the sayd Anne Housden deceased ... to the sayd Richard Housden to be cancelled and no suyte to be p[ro]sequ... thervppon at any tyme here after. And a Tenement and Garden claymed by the sayd John Housdens sonne Richard And other suyts brought by the sayd Richard Housden and Thomas Ellis in the sayd Court of Whitehall against the sayd John Housden & your Oratrixe Alice to discover whether the sayd fortie pounds was not the p[ro]per money of the sayd Ann... ...hitehall against the sayd John Housden and your sayd Oratrix Alice to discover howe the sayd Richard Housden brother of the sayd Anne made a Will and devised fiftie pounds apeece to sixe of the sayd John Housdens Children w[hi]ch afterwards was put out of the Will and payd in his life tyme ... And Edward Housden Clerke the defts brother ... ...Order of the 26th of June 17o R It was ordered that the sayd then Complt Richard Housden should then stand & be committed to the prison of the Fleet for ... sayd conte.. of the F...et to take him into custodie accordingly And afterwards by an order of the 5th of November ...the sayd Thomas Ellis was latelie dead, and that Anne his daughter and wife of William Frisney was heire & Executrix to the sayd Thomas Ellis ... but the sayd Richard Housden William Frisney & his wife not p[er]forming the sayd Order the sayd Richard Housden was thervppon app[re]hended by the warden of the Fleet
