Did You Know?

  • Mary Exton and her husband John Exton were buried a week apart.
  • There is a gap in the marriages recorded in the Walkern parish register between November 1658 and November 1662, which may explain why I haven't been able to find the marriage of Thomas Ecton to Martha Exton. I can't find a marriage for John Exton and Mary Exton, either, but I suspect they may have married at a Quaker meeting.

In the Name of God Amen I John Exton of Yardley in the County of Hertford yeoman doe make ^and ordain^ this my last Will and Testament in manner and form following First I commit my soul into the hands of Almighty God my holy and heavenly Father and my Body to be buried in the Earth at the discretion of my Executor hereafter named and as for my wordly Goods I doe give and bequeath as followeth Item I doe give and bequeath one little piece of Pasture or Ley Ground inclosed at the upper end of my own Ground called Brixbery field being also called the burying place unto all Christian people to bury their dead there who doe desire the same frank and free without mony and without price so long as the World shall endure with all Ways and Foot pathes leading thereunto as also one common way for Horses Carts and Coaches to come out of Cottered Street on the Backside of John Sadlers House and Orchard leading unto the said burying place with all such retinue or Company that doth desire to see the dead Corps laid into the Ground as also one foot path in and through my own Barkside and Orchard during the said time of Burialls and further if in length of time the place be found too strait for the Graves then I doe give and bequeath an Addition unto the young Ashen and Elme Trees further into my own ground being about Twenty two foot one ways and about seventeen Foot the other Ways and that those Trees shall stand upon the new Bank and a four foot ditch beyond them and so stock up the old Fence and I doe hereby institute and appoint my son John Exton and my Grandson George Robins and my Grandson John Starr and my loving Friend Thomas Eddridge as Feoffees in Trust to see the same burying place kept and preserved in a christian and decent manner for the purpose intended and no otherwayes and also to whom they or anyone or two of them shall appoint after their decease Item I doe give and bequeath unto my lo Wife Mary Exton all my Freehold Lands and Houses whatsoever in Yardly Cottered and else where for and during the full time and Term of her naturall Life and that she make no strips nor Wast upon any part of the premises but keep the same in good repairs and tenantable or else Twenty pounds a year paid her by my son John Exton or his Heirs Executors or Administrators by four equall quarterly payments that is five pounds for each quarter provides that she shall always revocke her joynture being part of my Freehold Lands and also such Beds and Bedding as shall be necessary for a Woman of her degree and after her decease I doe give and bequeath all my Houses and Lands both Copy and Freehold whatsoever unto my son John Exton and unto his Heirs for ever upon Condition that he shall pay all my debts Legacies and Buriall Charges Item I doe give and bequeath unto my daughter Elizabeth Robines the sum of One hundred pounds to be paid her two years after the decease of Mary my Wife and soon after that I doe give and bequeath unto all her Children five pounds apiece to be paid them at the Age of four and twenty years apiece Item I doe give and bequeath unto my daughter Susannah Lucus the sum of One hundred pounds to be paid her four Years after the decease of Mary my Wife and soon after that I doe give and bequeath unto all her Children five pounds apiece to be paid them as they shall attain to the Age of four and twenty Years apiece Item I doe give and bequeath unto my daughter Esther Breett the Sum of One hundred pounds to be paid her six Years after the decease of Mary my Wife and soon after that I doe give and bequeath unto all her the time limited and appointed after demand made of the same that then the party grieved shall have full power and Authority to distrain upon any part or parcell of my Freehold Lands or Tenements with all other the premises and to take lead carry and drive away any or all the Goods that they or any of them shall shall [sic] find upon them whether it be live stock or dead stock and the same retain and keep untill the End of three days and if not redeemed by payment of the moneys then to appraised and sell the same and to returne the overplus to the Owner if any be and if that will not doe to pay the debt and reasonable Charges then the party or parties grieved shall receive all the Rents and Profitts of all my Freehold Lands and premises both in Yardley and Cottered or else where Timber and Timber Trees always excepted untill the just and due Gift or Legacy be honestly paid Item I give also unto my son John Exton all my Farming stock with Graine Corne Hay Cows Sheep Horses Carts Plowes Harrows Waggons and all other Implements of Husbandry with all my Goods and Chattles to him and his Heirs for ever and doe also make and ordain my loving son John Exton full and sole Executor of this my last Will and Testament as is within written and doe also as is aforesaid frustrate and make void all Wills and Testaments by me formerly made and for the confirmation of this and the within written Will and Testament I have hereunto with my own hand signed and sealed the same the 18th day of the same Tenth month called december 1710 ./.
